Welcome to Auto Drive Rentals. By booking, renting, or driving one of our vehicles, you agree to these Terms & Conditions. Please read them carefully before confirming your rental.
1. Who We Are
Auto Drive Rentals Pty Ltd provides car rental services in New South Wales, Australia.

2. Eligibility to Rent
To rent and drive our vehicles, you must:

Be at least 20 years old

Hold a current, full, and valid driver’s licence

Have held your licence for at least 12 months
-
Provide valid identification and payment details before pickup
We reserve the right to refuse a rental if you do not meet these conditions or if your driving record is unsatisfactory.
3. Rental Period

The rental period begins when you take possession of the vehicle and ends when it is returned to us.

Extensions must be approved by us before your scheduled return time.

Late returns may incur additional daily or hourly charges.
4. Vehicle Use
You agree to:

Use the vehicle in a safe and lawful manner at all times

Drive only on sealed roads (unless otherwise approved)
-
Return the vehicle in the same condition it was received (reasonable wear and tear accepted)
-
Not smoke or carry pets in the vehicle (unless permitted)
-
Not drive under the influence of alcohol, drugs, or any illegal substance
-
Not use the vehicle for ridesharing, racing, towing, or unlawful purposes
Only the named driver(s) on the rental agreement may drive the vehicle.
5. Payments and Deposits

You agree to pay all rental fees, deposits, tolls, fuel charges, fines, and damage costs as outlined in your rental agreement or booking.

A security bond/deposit may be required. This will be refunded once the vehicle is returned in acceptable condition, subject to inspection and any outstanding charges.

Payment can be made by approved credit/debit card or other agreed methods.
6. Fuel
Unless stated otherwise:

The vehicle will be provided with a full tank of fuel.
-
You must return it with a full tank.

A refuelling fee may apply if the vehicle is returned with less fuel than supplied.
7. Insurance and Liability
Our vehicles are covered by comprehensive motor vehicle insurance subject to an excess.
You may still be responsible for:

The insurance excess (even if you’re not at fault)
-
Damage due to negligence, misuse, or breach of these Terms
-
Tyre, windscreen, or underbody damage (unless covered by optional protection)
-
Loss of keys or personal items
Optional excess reduction cover may be available at an additional cost. Ask us for details.
8. Accidents and Damage
If you’re involved in an accident, you must:

Ensure everyone is safe and contact emergency services if required.

Notify us immediately and complete an incident report.
-
Provide details of all parties involved (names, contact info, vehicle registration, insurance).
-
Not admit fault or promise payment to others.
Failure to report an accident or damage promptly may result in loss of insurance coverage.
9. Traffic Offences, Tolls & Fines
You are responsible for any parking fines, speeding tickets, tolls, or traffic infringements incurred during your rental period.
Where permitted by law, we may provide your details to authorities or charge your nominated payment method to cover these costs (including administrative fees).
10. Vehicle Return
When returning the vehicle, you must:

Return it to the agreed location and by the specified time

Ensure it’s clean and free from rubbish or debris
-
Allow a brief inspection for damage or excessive wear
A cleaning fee may apply if the vehicle requires special cleaning (e.g. pet hair, smoke smell, spills).
11. Cancellations and Refunds

Free cancellation may be available if you cancel at least [insert number] hours before pickup.

Cancellations made within [insert number] hours may incur a fee or loss of deposit.

No-shows (failure to collect the car) will result in forfeiture of any prepaid amount.
We reserve the right to cancel your booking due to unforeseen circumstances (e.g. vehicle unavailability, safety issues). If this occurs, a full refund will be provided.
12. Limitation of Liability
To the extent permitted by law, we are not liable for:

Loss or damage to your personal belongings

Consequential or indirect losses (e.g. loss of business or income)

Events beyond our reasonable control (e.g. accidents, weather, breakdowns)
Your rights under the Australian Consumer Law are not affected by this clause.
13. Privacy
We handle your personal information in accordance with our Privacy Policy (link to your privacy policy page).
This includes how we collect, store, and use your data for booking, payment, and legal compliance.
14. Governing Law
These Terms & Conditions are governed by the laws of New South Wales, Australia.
Any disputes will be subject to the exclusive jurisdiction of the courts of New South Wales.
15. Updates to These Terms
We may update these Terms & Conditions from time to time. The latest version will always be available on our website and will apply from the “Effective Date” above.
